Terms and conditions (EN)

DEFINITIONS

Employer – Direct employer or a recruitment agency in the Netherlands, which is a partner of Robin.

In accordance with contract terms, Robin undertakes to intermediate by providing the workplace in The Netherlands and the Candidate undertakes to give the correct and accurate information about himself for Robin and comply with other obligations under the contract. 

Robin OBLIGATIONS

Robin undertakes:

To give the correct information about employment opportunities and conditions in the Netherlands;

Upon approval, when the Employer agrees with the candidacy of employee and when the Candidate goes to The Netherlands, guarantee that the Candidate will be met, that accommodation will be found and that the maximum effort will be taken to employ the Candidate. 

 

Robin doesn’t guarantee that:

The Candidate will work full time – 8 hours per day, 40 hours per week. The beginning and ending of working hours, as well as the breaks, are determined by the Employer. 

The Candidate will work defined period (for example, month or year). The candidate knows that his working results will be evaluated by Employer in The Netherlands.  

 

CANDIDATE’S OBLIGATIONS 

Candidate undertakes:

to give to the service provider all necessary documents, information and correct data about himself; 

immediately inform the service provider about the changes of passport or other data (address, telephone number, etc.);

when the service provider finds a suitable job for the Candidate, to use his own funds to go to the workplace in The Netherlands, if it is not agreed otherwise

to inform service provider about decision not to go to the Netherlands not later than 24 hours before the scheduled departure time. If the candidate does not follow the agreement and does not inform on time about his decision not to leave to The Netherlands, the Candidate must pay 100 EUR surcharge for the service provider;

to inform the service provider about his health condition (different diseases, allergies,  injuries, which can affect the quality of the work) not later than the date of signature of this contract;

going to The Netherlands the Candidate must have identity documents (passport or ID), which is valid for at least  6 months, starting to run from the arrival to The Netherlands;

from the arrival to The Netherlands honestly, in time, accurately and professionally perform the job functions, follow the instructions of direct Employer or/and recruitment agency of The Netherlands and override stuff instructions; comply with laws, legal acts and professional standards and rules, provisions, working rules, which are defined by direct employer.

The Candidate declares and guarantees that:

he hasn’t been convicted (if the Candidate has been convicted, he must inform Robin before the signature of this contract);

he doesn’t have a voice of suspicion in any criminal proceedings;

he knows the conditions of recruitment services, working and living conditions in The Netherlands. (these conditions are considered as an integral part of the contract);

Candidate’s commitments for any third part is not the reason, which could interfere with employment  in The Netherlands;

the information and documents (or their copies) given to service provider are correct and legal; 

the Candidate is suitable for workplace in The Netherlands, which is proposed by service provider and  agreed with the Candidate. 

The Candidate commits to cover any direct loss of Robin, if this occur because of the fallibility of statements and guarantees, which were defined in paragraph 3.2 of the contract. 

 

OTHER PROVISIONS

The Candidate knows that Robin does not carry out the functions by the Employer, it means:

does not sign the employment contract;

does not administer and does not determine working and resting time of the Candidate;

does not apply  the disciplinary penalties;

does not determine the standards and rules of working;

does not evaluate the results of working of the Candidate;

can not exempt from the work;

does not carry out other functions of Employer.

The Candidate, which did not  fulfill the obligations of the contract, must cover any direct or indirect loss of Robin.

The Parties of the contract are not responsible for a failure of the contract if it happens due to force majeure

The contract comes into force from the moment of signing it and forces until the full obligations of the Parties under the contract implementation. 

The Parties have the right to terminate the contract by mutual written agreement. This contract also can be terminated unilaterally by informing other Party by email or/and  other written way before 2 working days. 

The contract is signed in duplicate, which have the same legal effect. 

 

UAB „Robin“ – SERVICE, WORKING AND LIVING  IN THE NETHERLANDS CONDITIONS. 

 

The person (further – Candiate), who would like to get a job in The Netherlands through „Robin“, knows that:

Neither „Robin“, neither employer or/and recruitment agency in The Netherlands do not guarantee that: 

The Candidate will work full time – 8 hours per day, 40 hours per week;

The Candidate will work defined period (for example, month or year).

The Candidate is informed that:

when the Candidate comes to The Netherlands, the employer or/and recruitment agency makes an additional selection: if the Candidate has aggressive behavior, is drunk or under the influence of drugs, or makes other actions which disturb public order, the employer or/and recruitment agency may refuse to sign the contract with that Candidate;

his working results will be evaluated by Employer in The Netherlands, not by „Robin“;

the beginning and ending of working hours, as well as the breaks, are determined by the Employer;

the employee must be very flexible looking to working conditions or working hours: should be ready to work less than 40 hours per week as well as overtime;

In The Netherlands the Candidate will sign employment and/or agency contract, under which the employer and/or recruitment agency undertakes only to pay a salary on time, also, the employer and/or recruitment agency can make a dismissal if: 

there is no work;

there are some problems because of discipline of the Candidate;

there are some problems because of productivity of the Candidate and work quality;

the Candidate has some serious problems with his health (health insurance of the agency does not cover any compensations, it covers only required assistance); 

there are other reasons, which depends on internal order of the Employer and/or recruitment agency and law of The Netherlands. 

The Candidate is informed about living conditions in The Netherlands:

the Candidate is accommodated in a private house, where live about 10 people, from 2 to 4 persons in the room; 

all the inhabitants share a common kitchen, a living room and a bathroom; 

the Candidate goes to the job and from it by the transport which is provided by the Employer and/or recruitment agency:

if the distance is less than 10 km., the Candidate goes by bicycle;

if the distance is more than 10 km., the Candidate goes by agency or private car. 

These conditions are an addition of the service contract, which is signed between „Robin“ and the Candidate. The conditions can not be regarded as exclusive, on which Parties have agreed. These  conditions are presented as an example and are given as information to a Candidate who wants to go to work to The Netherlands through Robin.  

 

The person (further – Client), who would like to get a job in The Netherlands through „Robin“, knows that:

Neither „Robin“, neither employer or/and recruitment agency in The Netherlands do not guarantee that:

The Client is informed that:
