Kniha 7 BW se konkr\u00e9tn\u011b zab\u00fdv\u00e1 pracovn\u00edmi smlouvami a zd\u016fraz\u0148uje pravidla pro z\u00e1kladn\u00ed principy, zku\u0161ebn\u00ed dobu, agenturn\u00ed pr\u00e1ci, dlouhodob\u00e1 zam\u011bstn\u00e1n\u00ed a ukon\u010den\u00ed smluv.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">V Nizozemsku existuje n\u011bkolik typ\u016f ukon\u010den\u00ed pracovn\u00edho pom\u011bru, kter\u00e9 z\u00e1kon uzn\u00e1v\u00e1, a ka\u017ed\u00fd z nich p\u0159in\u00e1\u0161\u00ed vlastn\u00ed soubor d\u016fsledk\u016f a pravidel.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Vz\u00e1jemn\u00e1 dohoda<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Vz\u00e1jemn\u00e1 dohoda je \u010dasto pova\u017eov\u00e1na za nejsm\u00edrn\u011bj\u0161\u00ed mo\u017enost, kter\u00e1 zahrnuje dohodu o ukon\u010den\u00ed nebo narovn\u00e1n\u00ed. To znamen\u00e1, \u017ee ob\u011b strany souhlas\u00ed s ukon\u010den\u00edm pracovn\u00ed smlouvy a jsou s n\u00edm srozum\u011bny. Pokud m\u00e1te d\u016fvody nesouhlasit s jej\u00edm obsahem, m\u00e1te v\u017edy pr\u00e1vo vyhledat pr\u00e1vn\u00ed radu nebo pomoc.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Konkr\u00e9tn\u011b byste se m\u011bli zam\u011b\u0159it na detaily, jako jsou:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">D\u016fvody propu\u0161t\u011bn\u00ed (pokud vznikl konflikt a vy jste za n\u011bj zodpov\u011bdn\u00ed, nemus\u00edte m\u00edt po podpisu n\u00e1rok na podporu v nezam\u011bstnanosti).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">V\u00fdplata zb\u00fdvaj\u00edc\u00edch bonus\u016f, dovolen\u00e9 nebo jin\u00fdch benefit\u016f.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Kone\u010dn\u00e1 mzda a celkov\u00e1 d\u00e9lka trv\u00e1n\u00ed pr\u00e1ce.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Concurrentiebeding (konkuren\u010dn\u00ed dolo\u017eka), kter\u00e1 v\u00e1s m\u016f\u017ee na ur\u010ditou dobu omezit v nab\u00edzen\u00ed va\u0161ich slu\u017eeb konkuren\u010dn\u00edm spole\u010dnostem.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Odstupn\u00e9 nebo jin\u00e9 kompenzace.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Pokud s podm\u00ednkami propu\u0161t\u011bn\u00ed nesouhlas\u00edte, mus\u00ed v\u00e1\u0161 zam\u011bstnavatel po\u017e\u00e1dat UWV nebo kanton\u00e1ln\u00ed soud o povolen\u00ed k ukon\u010den\u00ed pracovn\u00edho vztahu.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Propu\u0161t\u011bn\u00ed p\u0159es UWV<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Pokud se d\u016fvody ukon\u010den\u00ed t\u00fdkaj\u00ed specifick\u00fdch ekonomick\u00fdch okolnost\u00ed podniku, jako je hromadn\u00e9 propou\u0161t\u011bn\u00ed, reorganizace, restrukturalizace nebo dlouhodob\u00e1 nemoc (po p\u0159ibli\u017en\u011b dvou letech nep\u0159\u00edtomnosti v pr\u00e1ci), mus\u00ed zam\u011bstnavatel po\u017e\u00e1dat UWV o povolen\u00ed k ukon\u010den\u00ed va\u0161\u00ed smlouvy. UWV pot\u00e9 posoud\u00ed d\u016fvody propu\u0161t\u011bn\u00ed a dodr\u017een\u00ed postup\u016f a m\u016f\u017ee d\u00e1t zelenou, pokud jsou d\u016fvody platn\u00e9.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">D\u016fvody propu\u0161t\u011bn\u00ed by m\u011bly spadat pod body A\u2013I, neboli z\u00e1konn\u00e9 d\u016fvody propu\u0161t\u011bn\u00ed. Jedn\u00e1 se o specifick\u00e9, p\u0159edem definovan\u00e9 d\u016fvody, d\u00edky nim\u017e je propu\u0161t\u011bn\u00ed ze strany zam\u011bstnavatele spravedliv\u00e9. V takov\u00fdch p\u0159\u00edpadech maj\u00ed pr\u00e1vo podat n\u00e1mitky a rozhodovac\u00ed obdob\u00ed m\u016f\u017ee trvat a\u017e 12 t\u00fddn\u016f. Pokud UWV vyhov\u00ed \u017e\u00e1dosti zam\u011bstnavatele, je zam\u011bstnanci doru\u010dena v\u00fdpov\u011b\u010f a m\u016f\u017ee m\u00edt n\u00e1rok na p\u0159echodn\u00e9 odstupn\u00e9 jako formu kompenzace.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Propu\u0161t\u011bn\u00ed prost\u0159ednictv\u00edm kanton\u00e1ln\u00edho soudu<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Pokud jsou d\u016fvody potenci\u00e1ln\u00edho ukon\u010den\u00ed zam\u011bstn\u00e1n\u00ed zp\u016fsobeny osobn\u00edmi probl\u00e9my, jako je nevhodn\u00e9 chov\u00e1n\u00ed, naru\u0161en\u00e9 pracovn\u00ed vztahy, nedostate\u010dn\u00fd v\u00fdkon nebo jak\u00e1koli jin\u00e1 nal\u00e9hav\u00e1 z\u00e1le\u017eitost, kter\u00e1 nespad\u00e1 do kompetence UWV, mus\u00ed se zam\u011bstnavatel obr\u00e1tit na kanton\u00e1ln\u00ed soud s \u017e\u00e1dost\u00ed o ukon\u010den\u00ed (rozv\u00e1z\u00e1n\u00ed) pracovn\u00ed smlouvy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Soud mus\u00ed p\u0159\u00edpad pe\u010dliv\u011b p\u0159ezkoumat a zajistit, aby byly spln\u011bny v\u0161echny povinnosti zam\u011bstnavatele a bylo vynalo\u017eeno dostate\u010dn\u00e9 \u00fasil\u00ed k vy\u0159e\u0161en\u00ed probl\u00e9mu.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Zam\u011bstnavatel\u00e9 tak\u00e9 nemohou n\u011bkoho jednodu\u0161e propustit kv\u016fli \u0161patn\u00e9mu pracovn\u00edmu v\u00fdkonu. Nejprve mus\u00ed zam\u011bstnanci obdr\u017eet form\u00e1ln\u00ed zp\u011btnou vazbu b\u011bhem sch\u016fzky nebo pl\u00e1novan\u00fdch hodnocen\u00ed v\u00fdkonu. Mus\u00ed b\u00fdt vypracov\u00e1n verbetertraject neboli pl\u00e1n zlep\u0161en\u00ed v\u00fdkonu (ve form\u011b dodate\u010dn\u00e9ho veden\u00ed nebo \u0161kolen\u00ed) a implementov\u00e1n v n\u00e1sleduj\u00edc\u00edch t\u00fddnech nebo m\u011bs\u00edc\u00edch, aby pomohl zam\u011bstnanci zlep\u0161it jeho v\u00fdkon. Pokud se probl\u00e9my nevy\u0159e\u0161\u00ed a produktivita se \u010dasem nezlep\u0161\u00ed, m\u00e1 zam\u011bstnavatel p\u00e1dn\u00e9 d\u016fvody k ukon\u010den\u00ed pom\u011bru.<\/span><\/p>\n<h4><b>Role soudu<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Pokud pl\u00e1n zlep\u0161en\u00ed sel\u017ee, m\u016f\u017ee se zam\u011bstnavatel, jak ji\u017e bylo zm\u00edn\u011bno, obr\u00e1tit na okresn\u00ed soud, aby z\u00edskal souhlas s ukon\u010den\u00edm smlouvy se zam\u011bstnancem. Povinnost\u00ed soudu je p\u0159ed ud\u011blen\u00edm povolen\u00ed zam\u011bstnavateli zkontrolovat, zda propu\u0161t\u011bn\u00ed spl\u0148uje v\u0161echna z\u00e1konn\u00e1 krit\u00e9ria.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Zam\u011bstnanec m\u00e1 tak\u00e9 pr\u00e1vo napadnout rozhodnut\u00ed soudu, pokud se p\u0159iklon\u00ed na stranu zam\u011bstnavatele. I v takov\u00e9m p\u0159\u00edpad\u011b soud vyd\u00e1 ozn\u00e1men\u00ed na konci v\u00fdpov\u011bdn\u00ed lh\u016fty a smlouva bude ukon\u010dena. Zam\u011bstnanci mohou m\u00edt n\u00e1rok na od\u0161kodn\u011bn\u00ed na z\u00e1klad\u011b d\u016fvod\u016f propu\u0161t\u011bn\u00ed.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Okam\u017eit\u00e9 propu\u0161t\u011bn\u00ed<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Jedn\u00e1 se o nejp\u0159\u00edsn\u011bj\u0161\u00ed formu ukon\u010den\u00ed pracovn\u00edho pom\u011bru, vyhrazenou pouze pro extr\u00e9mn\u00ed p\u0159\u00edpady a p\u0159\u00edpady hrub\u00e9ho poru\u0161en\u00ed pracovn\u00ed k\u00e1zn\u011b nebo nal\u00e9hav\u00e9 d\u016fvody, jako je z\u00e1va\u017en\u00e1 neposlu\u0161nost nebo kr\u00e1de\u017e. Okam\u017eit\u00e9 propu\u0161t\u011bn\u00ed umo\u017e\u0148uje okam\u017eit\u00e9 ukon\u010den\u00ed smlouvy bez v\u00fdpov\u011bdn\u00ed lh\u016fty. D\u016fkazn\u00ed b\u0159emeno pro nal\u00e9hav\u00fd d\u016fvod je v\u0161ak vysok\u00e9 a zam\u011bstnanec jej m\u016f\u017ee napadnout u soudu.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Zam\u011bstnanci, kte\u0159\u00ed jsou propu\u0161t\u011bni t\u00edmto zp\u016fsobem, nemaj\u00ed n\u00e1rok na podporu v nezam\u011bstnanosti.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Dal\u0161\u00ed formy propu\u0161t\u011bn\u00ed<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Dostat v\u00fdpov\u011b\u010f v Nizozemsku nen\u00ed p\u0159\u00edmo\u010dar\u00fd proces, nicm\u00e9n\u011b existuj\u00ed p\u0159\u00edpady, kdy propu\u0161t\u011bn\u00ed nemus\u00ed zahrnovat \u017e\u00e1dn\u00e9 pr\u00e1vn\u00ed subjekty. To se t\u00fdk\u00e1 i p\u0159\u00edpad\u016f, kdy pod\u00e1n\u00ed v\u00fdpov\u011bdi v Nizozemsku nemus\u00ed zahrnovat \u017e\u00e1dn\u00e9 t\u0159et\u00ed strany.<\/span><\/p>\n<h4><b>Konstruktivn\u00ed propu\u0161t\u011bn\u00ed v Nizozemsku<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">To se t\u00fdk\u00e1 situace, kdy se zam\u011bstnanec c\u00edt\u00ed nucen odej\u00edt kv\u016fli poru\u0161en\u00ed smlouvy ze strany zam\u011bstnavatele a vytvo\u0159en\u00ed nesnesiteln\u00fdch pracovn\u00edch podm\u00ednek. Od nebezpe\u010dn\u00e9ho prost\u0159ed\u00ed p\u0159es obt\u011b\u017eov\u00e1n\u00ed a\u017e po v\u00fdznamn\u00e9 zm\u011bny v pracovn\u00edch povinnostech \u2013 zam\u011bstnavatel na v\u00e1s m\u016f\u017ee vyv\u00edjet tlak, abyste svou roli opustili.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A\u010dkoli tento koncept nen\u00ed v nizozemsk\u00e9m pr\u00e1vu v\u00fdslovn\u011b definov\u00e1n, \u00fa\u0159ady budou tyto p\u0159\u00edpady posuzovat jako nespr\u00e1vn\u00e9 propu\u0161t\u011bn\u00ed (onrechtmatig ontslag) nebo vynucenou rezignaci. M\u016f\u017eete m\u00edt tak\u00e9 n\u00e1rok na od\u0161kodn\u011bn\u00ed a podporu v nezam\u011bstnanosti, ale budete muset p\u0159edlo\u017eit siln\u00e9 d\u016fkazy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nej\u010dast\u011bji se tyto p\u0159\u00edpady \u0159e\u0161\u00ed prost\u0159ednictv\u00edm pr\u00e1vn\u00edho poradenstv\u00ed nebo mediace, co\u017e \u010din\u00ed dokumentov\u00e1n\u00ed a hl\u00e1\u0161en\u00ed jak\u00fdchkoli probl\u00e9m\u016f na pracovi\u0161ti je\u0161t\u011b d\u016fle\u017eit\u011bj\u0161\u00edm.<\/span><\/p>\n<h4><b>Propu\u0161t\u011bn\u00ed\/Rezignace b\u011bhem zku\u0161ebn\u00ed doby<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Z\u00e1kon nezmi\u0148uje \u017e\u00e1dn\u00e9 podm\u00ednky pro ukon\u010den\u00ed pracovn\u00edho pom\u011bru ve zku\u0161ebn\u00ed dob\u011b. Zam\u011bstnanec tak\u00e9 nemus\u00ed uv\u00e1d\u011bt d\u016fvod sv\u00e9 rezignace.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tyto p\u0159\u00edpady jsou mnohem p\u0159\u00edmo\u010da\u0159ej\u0161\u00ed ne\u017e p\u0159\u00edpady ukon\u010den\u00ed smluv na dobu neur\u010ditou v Nizozemsku.<\/span><\/p>\n<h4><b>Vypr\u0161en\u00ed smlouvy na dobu ur\u010ditou<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Vzhledem k tomu, \u017ee tato pracovn\u00ed ujedn\u00e1n\u00ed ji\u017e maj\u00ed p\u0159edem definovan\u00e1 data ukon\u010den\u00ed, nemohou zam\u011bstnanci podniknout mnoho pr\u00e1vn\u00edch krok\u016f, pokud se zam\u011bstnavatel\u00e9 rozhodnou smlouvu neprodlou\u017eit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tyto smlouvy v\u0161ak nelze ukon\u010dit p\u0159ed\u010dasn\u011b, s v\u00fdjimkou p\u0159\u00edpad\u016f vz\u00e1jemn\u00e9 dohody (nebo pokud nen\u00ed ve smlouv\u011b dohodnuto jinak). Zam\u011bstnavatel mus\u00ed tak\u00e9 zam\u011bstnanci s p\u0159edstihem sd\u011blit, zda bude smlouva prodlou\u017eena nebo ukon\u010dena. Pokud zam\u011bstnavatel neinformuje zam\u011bstnance alespo\u0148 m\u011bs\u00edc p\u0159edem, m\u00e1 zam\u011bstnanec pr\u00e1vo mu to p\u0159ipomenout.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tyto smlouvy se automaticky st\u00e1vaj\u00ed trval\u00fdmi, pokud m\u011bl zam\u011bstnanec u stejn\u00e9ho zam\u011bstnavatele alespo\u0148 t\u0159i smlouvy na dobu ur\u010ditou nebo byl do\u010dasn\u011b zam\u011bstn\u00e1n d\u00e9le ne\u017e dva roky.
