Pot\u00e9 m\u016f\u017ee zam\u011bstnavatel ukon\u010dit pracovn\u00ed smlouvu pouze z platn\u00fdch d\u016fvod\u016f stanoven\u00fdch nizozemsk\u00fdm pracovn\u00edm pr\u00e1vem.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pracovn\u00ed smlouvy na dobu ur\u010ditou (nebo smlouvy na dobu ur\u010ditou) maj\u00ed stanoven\u00e9 datum ukon\u010den\u00ed, po kter\u00e9m zam\u011bstnavatel nem\u00e1 v\u016f\u010di pracovn\u00edkovi \u017e\u00e1dn\u00e9 smluvn\u00ed z\u00e1vazky. Tyto pracovn\u00ed smlouvy na dobu ur\u010ditou se \u010dasto pou\u017e\u00edvaj\u00ed pro sez\u00f3nn\u00ed pracovn\u00edky, zam\u011bstnance v r\u00e1mci projekt\u016f a pracovn\u00edky na \u010d\u00e1ste\u010dn\u00fd \u00favazek.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Zam\u011bstnanci mohou b\u00fdt nab\u00eddnuty t\u0159i po sob\u011b jdouc\u00ed smlouvy na dobu ur\u010ditou, ale smlouva bude zm\u011bn\u011bna na smlouvu na dobu neur\u010ditou, pokud celkov\u00e1 d\u00e9lka p\u0159es\u00e1hne 36 m\u011bs\u00edc\u016f (t\u0159i roky).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Z\u00e1kon stanov\u00ed, \u017ee \u010dtvrt\u00e1 smlouva na dobu ur\u010ditou mus\u00ed b\u00fdt uzav\u0159ena na dobu neur\u010ditou, i kdy\u017e p\u0159edchoz\u00ed smlouvy byly krat\u0161\u00ed ne\u017e 36 m\u011bs\u00edc\u016f.<\/span><\/p>\n<h2>Co je kolektivn\u00ed smlouva (CAO)?<\/h2>\n<p><span style=\"font-weight: 400;\">Krom\u011b z\u00e1kladn\u00edch pravidel stanoven\u00fdch nizozemsk\u00fdm pracovn\u00edm pr\u00e1vem maj\u00ed spole\u010dnosti \u010dasto s odbory uzav\u0159en\u00e9 zvl\u00e1\u0161tn\u00ed dohody, kter\u00e9 stanov\u00ed zvl\u00e1\u0161tn\u00ed smluvn\u00ed podm\u00ednky. Jedn\u00e1 se o kolektivn\u00ed pracovn\u00ed smlouvy neboli CLA (nizozemsky: Collectieve Arbeidsovereenkomst, CAO). V\u011bt\u0161ina <a href=\"https:\/\/robin.jobs\/cz\/prace-v-holandsku\">pracovn\u00edch m\u00edst v Nizozemsku<\/a> spad\u00e1 pod CAO.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Existuj\u00ed dva typy pracovn\u00edch smluv: odv\u011btvov\u00e9 kolektivn\u00ed smlouvy a podnikov\u00e9 kolektivn\u00ed smlouvy. Prvn\u00ed z nich se t\u00fdk\u00e1 smluv v r\u00e1mci jednoho odv\u011btv\u00ed (druhu pr\u00e1ce), zat\u00edmco druh\u00e1 se t\u00fdk\u00e1 pracovn\u00edch smluv na \u00farovni podniku pro v\u0161echny zam\u011bstnance. CAO mohou nab\u00edzet pouze lep\u0161\u00ed pracovn\u00ed podm\u00ednky, ne\u017e stanov\u00ed z\u00e1kon. Pokud m\u00e1 spole\u010dnost uzav\u0159enou kolektivn\u00ed smlouvu, nemohou pracovn\u00ed podm\u00ednky odporovat CAO.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Dopad CAO na pracovn\u00ed smlouvy<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Kolektivn\u00ed pracovn\u00ed smlouvy (CLA nebo CAO) v Nizozemsku mohou ovlivnit podm\u00ednky pracovn\u00edch smluv. T\u00edm poskytuj\u00ed dal\u0161\u00ed pr\u00e1va a ochranu v oblasti zam\u011bstnanosti. Stanoven\u00edm z\u00e1kladn\u00ed \u00farovn\u011b zaji\u0161\u0165uj\u00ed KSP zam\u011bstnanc\u016fm ur\u010ditou \u00farove\u0148 ochrany bez ohledu na jejich pracovn\u00ed smlouvy. Tyto dohody ur\u010duj\u00ed mj:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">mzdy,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">pracovn\u00ed doba,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">v\u00fdpov\u011bdn\u00ed lh\u016fty,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">p\u0159echodn\u00e9 platby,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">d\u016fchody.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">P\u0159izp\u016fsoben\u00ed pracovn\u00edch smluv prost\u0159ednictv\u00edm CLA<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Pracovn\u00ed smlouvy (CAO) umo\u017e\u0148uj\u00ed zam\u011bstnavatel\u016fm a zam\u011bstnanc\u016fm p\u0159izp\u016fsobit pracovn\u00ed smlouvy jejich pot\u0159eb\u00e1m. N\u00ed\u017ee je uvedeno n\u011bkolik mo\u017enost\u00ed, kter\u00e9 ob\u011bma z\u00fa\u010dastn\u011bn\u00fdm stran\u00e1m umo\u017e\u0148uj\u00ed dos\u00e1hnout co nejlep\u0161\u00ed dohody:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Individu\u00e1ln\u00ed dohody mohou b\u00fdt v r\u00e1mci CLA povoleny, pokud jsou tyto odchylky pro zam\u011bstnance v\u00fdhodn\u00e9.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Kolektivn\u00ed vyjedn\u00e1v\u00e1n\u00ed umo\u017e\u0148uje zam\u011bstnavatel\u016fm a zam\u011bstnanc\u016fm sjedn\u00e1vat kolektivn\u00ed smlouvy na podnikov\u00e9 \u00farovni, kter\u00e9 mohou obsahovat ustanoven\u00ed nad r\u00e1mec t\u011bch, kter\u00e1 jsou obsa\u017eena v CLA pro cel\u00e9 odv\u011btv\u00ed nebo stanovena jako minimum podle nizozemsk\u00e9ho pracovn\u00edho pr\u00e1va.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Kolektivn\u00ed smlouvy mohou obsahovat ustanoven\u00ed o flexibilit\u011b, kter\u00e1 umo\u017e\u0148uj\u00ed odchylky od ur\u010dit\u00fdch po\u017eadavk\u016f za ur\u010dit\u00fdch okolnost\u00ed, jako jsou ekonomick\u00e9 pot\u00ed\u017ee nebo individu\u00e1ln\u00ed pot\u0159eby zam\u011bstnance.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Jak\u00e9 jsou v\u00fdhodn\u011bj\u0161\u00ed podm\u00ednky CLA?<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Lep\u0161\u00ed plat: \u010casto je v nich stanovena mzda vy\u0161\u0161\u00ed ne\u017e minim\u00e1ln\u00ed mzda a mohou obsahovat ustanoven\u00ed o zv\u00fd\u0161en\u00ed mzdy na z\u00e1klad\u011b d\u00e9lky praxe nebo dosa\u017een\u00fdch o\u010dek\u00e1van\u00fdch v\u00fdsledk\u016f.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Lep\u0161\u00ed pracovn\u00ed podm\u00ednky: CLA mohou stanovit bezpe\u010dn\u011bj\u0161\u00ed pracovn\u00ed prost\u0159ed\u00ed, krat\u0161\u00ed pracovn\u00ed dobu nebo pru\u017en\u011bj\u0161\u00ed pracovn\u00ed podm\u00ednky.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dal\u0161\u00ed v\u00fdhody: CLA mohou nab\u00edzet \u0161kolen\u00ed sponzorovan\u00e9 spole\u010dnost\u00ed, dodate\u010dn\u00e9 zdravotn\u00ed poji\u0161t\u011bn\u00ed, p\u0159\u00edsp\u011bvky na p\u00e9\u010di o d\u011bti, neomezen\u00e9 placen\u00e9 volno nebo programy pomoci zam\u011bstnanc\u016fm.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Zlep\u0161en\u00e9 postupy p\u0159i ukon\u010den\u00ed pracovn\u00edho pom\u011bru: CLA mohou nab\u00edzet lep\u0161\u00ed podm\u00ednky v p\u0159\u00edpad\u011b ukon\u010den\u00ed smlouvy, nap\u0159\u00edklad del\u0161\u00ed v\u00fdpov\u011bdn\u00ed lh\u016fty a lep\u0161\u00ed p\u0159echodn\u00e9 platby..<\/span><\/li>\n<\/ul>\n<h2>Ukon\u010den\u00ed pracovn\u00edch smluv v Nizozemsku<\/h2>\n<p><span style=\"font-weight: 400;\">V\u00fdpov\u011b\u010f smlouvy m\u016f\u017ee b\u00fdt jednostrann\u00e1 (ze strany zam\u011bstnance nebo zam\u011bstnavatele), v takov\u00e9m p\u0159\u00edpad\u011b mus\u00ed b\u00fdt stanovena v\u00fdpov\u011bdn\u00ed lh\u016fta. T\u00edm se zam\u011bstnavatel vyhne procesu propou\u0161t\u011bn\u00ed prost\u0159ednictv\u00edm zam\u011bstnaneck\u00e9 poji\u0161\u0165ovny a pracovn\u00edho soudu.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Pr\u00e1vn\u00ed d\u016fvody ukon\u010den\u00ed pracovn\u00edho pom\u011bru<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Zam\u011bstnavatel m\u016f\u017ee ukon\u010dit pracovn\u00ed smlouvu z platn\u00e9ho d\u016fvodu. Mezi platn\u00e9 d\u016fvody pro ukon\u010den\u00ed pracovn\u00edho pom\u011bru pat\u0159\u00ed probl\u00e9my s v\u00fdkonem pr\u00e1ce, \u0161patn\u00e9 chov\u00e1n\u00ed, neuspokojiv\u00e1 pr\u00e1ce, nek\u00e1ze\u0148, nadbyte\u010dnost a poru\u0161en\u00ed smlouvy. Dal\u0161\u00edm d\u016fvodem je dosa\u017een\u00ed d\u016fchodov\u00e9ho v\u011bku zam\u011bstnance.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Situace, kdy zam\u011bstnavatel nem\u016f\u017ee zam\u011bstnance propustit<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Nizozemsk\u00e9 pracovn\u00ed pr\u00e1vo zn\u00e1 situace, kdy je zam\u011bstnanec chr\u00e1n\u011bn p\u0159ed ztr\u00e1tou zam\u011bstn\u00e1n\u00ed.
